Welcome to SkateAI. These Terms of Service (“Terms”) govern your access to and use of the SkateAI application, website, and related services (“Services”).
By using SkateAI, you agree to these Terms.
If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use SkateAI.
If you are under the age of majority in your jurisdiction, you must have permission from a parent or guardian.
2. Nature of the Service
SkateAI provides AI-generated skateboarding coaching and progression feedback based on uploaded videos and user inputs.
The Services are intended for:
- informational purposes
- training assistance
- entertainment
- skill development
SkateAI is not a certified professional skateboarding instructor, medical provider, or safety authority.
3. Assumption of Risk
Skateboarding is an inherently dangerous activity that can result in:
- falls
- injuries
- permanent disability
- or death
By using SkateAI, you acknowledge and accept all risks associated with skateboarding and physical activity.
You are solely responsible for:
- your actions
- your environment
- your equipment
- your safety decisions
Always wear appropriate safety gear and skate responsibly.
4. No Professional Advice
AI-generated coaching, recommendations, progression suggestions, and analysis are provided “as is.”
SkateAI does not guarantee:
- trick success
- injury prevention
- coaching accuracy
- progression outcomes
- or performance improvement
You should not rely exclusively on SkateAI for training or safety decisions.
5. User Accounts
You are responsible for:
- maintaining account security
- protecting login credentials
- all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
6. User Content
You retain ownership of content you upload.
You grant SkateAI a non-exclusive, worldwide license to:
- host
- process
- analyze
- reproduce
- and display uploaded content as necessary to provide the Services
You represent that:
- you own or control rights to uploaded content
- your content does not violate laws or third-party rights
- your uploads do not contain unlawful material
7. Prohibited Conduct
You agree not to:
- upload illegal or abusive content
- attempt to reverse engineer the platform
- interfere with app security
- use bots or automated abuse systems
- upload harmful software
- misuse AI systems
- harass other users
8. Fair Use
SkateAI subscriptions include unlimited AI-powered skate coaching for normal personal use. Our goal is to provide every subscriber with a fast, reliable, and high-quality coaching experience.
To maintain service quality and protect the platform for all users, subscriptions are subject to this Fair Use Policy.
Normal personal use includes uploading videos from your own skate sessions, practicing tricks, reviewing multiple attempts, and using SkateAI as your personal training companion.
The following activities may be considered excessive or abusive use and are prohibited:
- Using automated tools, scripts, bots, or other methods to generate analyses.
- Sharing a subscription with multiple individuals.
- Using SkateAI to provide commercial coaching services or analyze videos on behalf of others.
- Uploading an unusually high volume of videos that is inconsistent with normal individual use.
- Attempting to interfere with, overload, or disrupt SkateAI's systems or services.
- Circumventing technical limitations or security measures.
If unusually high usage or abusive activity is detected, SkateAI may, at its sole discretion:
- Delay or queue analysis requests during periods of high demand.
- Temporarily rate limit analysis requests.
- Request additional verification of account usage.
- Temporarily suspend access to AI analysis features while the account is reviewed.
- Suspend or terminate accounts that repeatedly violate this Fair Use Policy.
We strive to ensure that legitimate subscribers never encounter these protections during normal personal use. Any actions taken under this Fair Use Policy are intended solely to maintain a reliable experience for all SkateAI users.
SkateAI reserves the right to modify or update its Fair Use Policy at any time as necessary to protect the integrity, performance, and sustainability of the service.
9. Intellectual Property
All SkateAI branding, software, design, AI systems, graphics, and content are owned by SkateAI or its licensors.
You may not copy, distribute, or exploit SkateAI materials without permission.
10. Subscription & Payments
Certain features may require a paid subscription.
Subscriptions may:
- renew automatically
- be billed through Apple or Google
- be managed through your platform account settings
All purchases are subject to platform billing terms.
Refunds are governed by applicable app marketplace policies.
11. Termination
We may suspend or terminate access to the Services at any time if:
- you violate these Terms
- misuse the platform
- create legal or security risks
You may stop using the Services at any time.
12. Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE.”
To the fullest extent permitted by law, SkateAI disclaims all warranties including:
- merchantability
- fitness for a particular purpose
- accuracy
- reliability
- non-infringement
We do not guarantee uninterrupted or error-free operation.
13. Limitation of Liability
To the fullest extent permitted by law, SkateAI shall not be liable for:
- injuries
- accidents
- damages
- lost profits
- data loss
- emotional distress
- or indirect/consequential damages arising from use of the Services
Your use of SkateAI is at your own risk.
14. Indemnification
You agree to indemnify and hold harmless SkateAI and its affiliates from claims arising out of:
- your use of the Services
- your uploaded content
- your violation of these Terms
- your violation of applicable laws
15. Changes to the Services
We may modify, suspend, or discontinue portions of the Services at any time without liability.
16. Governing Law
These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles.
